1. Introduction
  These Terms and Conditions govern access to and use of the Lumivish website, platform, products, and related services (together, the Platform).
  By creating an account, purchasing a membership, making a contribution, creating a dream, or otherwise using Lumivish, the user agrees to be bound by these Terms and Conditions, the Privacy Policy, and any additional rules or policies published on the Platform.
  If a user does not agree with these Terms and Conditions, the user must not use the Platform.

1. About Lumivish
  Lumivish is an online mutual-support platform operated by Techelegante OÜ. The Platform allows members to support personal dreams submitted by other members through fixed contribution amounts and, subject to these Terms, to create and share their own dreams.
  Lumivish provides a technical and community platform for participation and payment facilitation. Lumivish does not guarantee that any dream will receive support, be fully funded, or be eligible for payout.

1. Eligibility
  To use Lumivish, a user must:
  • be at least 18 years old;
  • have full legal capacity to enter into binding agreements;
  • reside in a country or territory where Lumivish is made available by the Platform;
  • provide accurate, complete, and up-to-date information;
  • comply with these Terms and all applicable laws.
  Lumivish may currently restrict access to users residing in the European Union or other approved territories, as determined by the Platform from time to time.

1. Accounts
  Each user must create an account to access member features.
  A user is responsible for maintaining the confidentiality of login credentials and for all activity carried out through the account.
  A user may not create an account on behalf of another person without authorization, transfer an account, or use false identity information.
  Lumivish may suspend, restrict, or terminate any account that violates these Terms, creates legal or operational risk, or is suspected of fraud, abuse, chargeback activity, manipulation, or illegal conduct.

1. Membership
  Access to the Platform may require a paid membership.
  The current membership fee is €9.99 per year, unless otherwise stated on the Platform at the time of purchase.
  Membership fees are non-refundable except where required by applicable law or where expressly stated otherwise by Techelegante OÜ.
  Techelegante OÜ may change membership pricing, billing periods, membership features, or eligibility criteria at any time for future purchases or renewals.

1. Dreams
  Members may create personal dream pages on the Platform, subject to approval, moderation, eligibility, and the rules set out in these Terms. Current Platform rules may include the following:
  • a dream goal must be between €200 and €1500;
  • a member may have one active dream at a time;
  • a member may create a maximum of three dreams per calendar year.
  Techelegante OÜ may approve, reject, remove, pause, hide, or edit the display status of any dream that breaches these Terms, creates compliance risk, or is considered misleading, harmful, unlawful, offensive, deceptive, or unsuitable for the Platform.
2. Prohibited Dreams
  Users may not create, publish, promote, or use a dream for any purpose that:
  • relates to illegal products, services, or activities;
  • promotes violence, abuse, hate, discrimination, harassment, or threats;
  • involves weapons, explosives, dangerous materials, drugs, or other restricted substances;
  • involves adult content, sexual services, or exploitative content;
  • relates to gambling, betting, games of chance, or monetary prize schemes;
  • promotes lending, investment opportunities, crypto-related activity, or other regulated financial services;
  • is political in nature, including political campaigning, lobbying, or fundraising for political causes;
  • infringes intellectual property, privacy, publicity, or other third-party rights;
  • is fraudulent, misleading, deceptive, or misrepresents the purpose of the dream.
  Techelegante OÜ may remove any dream, restrict access, block payouts, or suspend accounts where a dream appears to violate these Terms, applicable law, payment provider rules, or platform safety standards.

1. Contributions
  Members may support dreams through contribution amounts made available on the Platform.
  Current standard contribution amounts may include €10, €15, and €20.
  Techelegante OÜ may set or change available contribution amounts, minimums, maximums, limits, and payment methods at any time.
  A user may be subject to a maximum aggregate contribution limit to another user, including a current limit of €100 per supported user, if that rule is active on the Platform at the relevant time.
  All contributions are voluntary unless clearly stated otherwise in a specific Platform rule. A contribution does not create any ownership right, repayment right, investment right, or guaranteed benefit for the contributor.
  Contributors are solely responsible for reviewing the dream information before making a contribution.

1. Participation Rules and Visibility
  Lumivish may use participation-based features to organize visibility, discovery, prioritization, or reduced platform fee eligibility within the community.
  This may include giving additional visibility, badges, prioritization, or reduced fee eligibility to members who actively participate in the Platform by supporting other members’ dreams.
  Platform features and ranking logic may change at any time and do not create any guaranteed right to exposure, traffic, funding, or payout.

1. Platform Fees
  Techelegante OÜ may charge platform fees in connection with successfully collected funds, memberships, or other Platform services.
  Unless otherwise stated on the Platform at the time of payout or transaction, the standard platform fee is 2% of successfully collected funds.
  A reduced platform fee of 2% may apply to eligible active members, subject to the participation rules then in force on the Platform.
  For the purposes of fee eligibility, an active member may be defined by the Platform as a member who has supported other dreams with a total amount equal to at least 10% of the member’s own dream goal, or who otherwise satisfies the active participation criteria published by the Platform at the relevant time.
  Techelegante OÜ reserves the right to update, replace, suspend, or redefine active member criteria, standard fees, reduced fees, and related eligibility rules at any time for future transactions.

1. Payment Processing and Payment Fees
  Payments may be processed by third-party payment service providers, including Stripe or other providers chosen by Techelegante OÜ.
  By using the Platform, users also agree to comply with the terms, onboarding requirements, verification requirements, and payment policies of the relevant payment provider.
  Any payment processing fees, card fees, currency conversion charges, banking fees, or third-party charges may be borne by the contributor, the dream owner, or both, depending on the payment flow shown on the Platform at the time of payment.
  Techelegante OÜ does not control the independent decisions of payment providers regarding onboarding, compliance checks, account verification, reserve requirements, holds, restrictions, reversals, or payout timing.

1. Payouts
  Payouts are subject to successful payment collection, account verification, compliance review, fraud screening, and the requirements of the relevant payment provider.
  Techelegante OÜ may require a dream owner to complete identity verification, connected account onboarding, tax-related declarations, and any additional compliance steps before a payout is released.
  Techelegante OÜ may delay, hold, limit, or refuse a payout where necessary to comply with law, payment provider requirements, fraud controls, sanctions screening, chargeback risk, platform rules, moderation policies, or these Terms.
  Eligibility for payout may also depend on then-current Platform rules, including participation-based rules or reduced fee rules published on the Platform at the relevant time.
  Techelegante OÜ does not guarantee uninterrupted or immediate payout availability.

1. Taxes
  Each user is solely responsible for determining, reporting, and paying any taxes, duties, or other public charges that may arise from the use of the Platform, including any taxes related to contributions received or paid.
  Techelegante OÜ does not provide tax advice, legal advice, or accounting advice to users.
  Users should seek independent professional advice in their own country of residence where necessary.

1. Prohibited Content and Conduct
  Users must not use Lumivish to:
  • post false, misleading, defamatory, hateful, violent, or unlawful content;
  • raise funds for illegal, harmful, discriminatory, or prohibited activities;
  • infringe intellectual property, privacy, publicity, or other rights of third parties;
  • impersonate another person or misrepresent identity, eligibility, or circumstances;
  • manipulate the Platform, visibility systems, fees, or participation metrics;
  • engage in fraud, self-dealing, circular payment schemes, money laundering, sanctions evasion, or abusive transaction patterns;
  • upload malicious code or interfere with the security or operation of the Platform.
  Techelegante OÜ may investigate suspected violations and take any action considered necessary, including removing content, reversing access, reporting to authorities or payment providers, and suspending or terminating accounts.

1. Moderation and Platform Discretion
  Techelegante OÜ reserves broad discretion to moderate content, interpret and apply Platform rules, determine eligibility, review participation status, and manage operational risk.
  No user has a guaranteed right to remain on the Platform, to have any dream published, to obtain any specific ranking or visibility level, or to receive support from the community.

1. Intellectual Property
  All rights in the Lumivish name, branding, website design, software, text, graphics, content structure, and other Platform materials belong to Techelegante OÜ or its licensors, except for content lawfully submitted by users.
  By submitting content to Lumivish, the user grants Techelegante OÜ a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, adapt, and distribute that content for the purpose of operating, improving, promoting, and protecting the Platform.
  The user represents that the user has all rights necessary to submit the content and grant this license.

1. No Financial, Investment, or Professional Advice
  Lumivish is not an investment service, banking service, deposit-taking service, or financial advisory service.
  Nothing on the Platform constitutes financial advice, legal advice, tax advice, or professional advice.

1. Disclaimers
  The Platform is provided on an “as is” and “as available” basis to the fullest extent permitted by law.
  Techelegante OÜ makes no representation or warranty that the Platform will always be available, secure, error-free, suitable for a user’s purposes, or free from interruption, delay, fraud attempts, or third-party failures.
  Techelegante OÜ does not guarantee the truthfulness, quality, legality, or outcome of any dream, contribution, or user interaction.

1. Limitation of Liability
  To the fullest extent permitted by applicable law, Techelegante OÜ will not be liable for any indirect, incidental, special, consequential, punitive, or loss-of-profit damages arising out of or in connection with the Platform.
  To the fullest extent permitted by law, the total aggregate liability of Techelegante OÜ for any claim arising out of or relating to the Platform shall not exceed the total amount of fees actually paid by the relevant user to Techelegante OÜ during the twelve months preceding the event giving rise to the claim.
  Nothing in these Terms excludes liability that cannot lawfully be excluded under applicable law.

1. Indemnity
  The user agrees to indemnify and hold harmless Techelegante OÜ, its directors, officers, employees, contractors, and affiliates from and against claims, losses, damages, liabilities, and expenses arising from the user’s breach of these Terms, misuse of the Platform, violation of law, or infringement of third-party rights.

1. Suspension and Termination
  Techelegante OÜ may suspend, restrict, or terminate access to the Platform at any time, with or without notice, where reasonably necessary for operational, legal, security, compliance, moderation, or risk reasons.
  A user may stop using the Platform at any time.
  Any provisions of these Terms which by nature should survive termination shall survive, including provisions on fees, taxes, intellectual property, disclaimers, liability, indemnity, governing law, and dispute resolution.

1. Changes to the Terms
  Techelegante OÜ may update these Terms and Conditions from time to time.
  Updated Terms become effective when published on the Platform, unless a later effective date is specified.
  Continued use of the Platform after updated Terms take effect constitutes acceptance of the updated Terms.

1. Governing Law and Jurisdiction
  These Terms and Conditions are governed by the laws of Estonia, unless mandatory consumer protection laws in the user’s country of residence require otherwise.
  Any dispute arising out of or in connection with these Terms shall be subject to the competent courts of Estonia, unless applicable mandatory consumer law provides otherwise.
  Platform Rules Summary
  The following summary is provided for convenience only. In the event of conflict, the main body of these Terms prevails.
